This is a copy of the agreement which will be forwarded to you to complete and return to us
prior to collection of your puppy/dog.
Over the years, no matter how much we impress on our clients to come back to us if there are any
problems, we have experienced a couple of instances where the family’s circumstances have changed and
we have not been given the opportunity to assist one of our puppies to be suitably rehomed. While we do
not believe we have the need or right to have control over puppy once it has been adopted out,
we do care enough to want to assist if circumstances change and ensure that the little people we’ve
brought into the world have the best opportunities for a lovely life. Therefore, it has been
necessary to require a legally binding, written and signed agreement from our families to cover
our rights as caring and responsible breeders and to continue to do the best we can for our
puppies should family circumstances change.
THIS RIGHT OF FIRST REFUSAL AND BREEDING AGREEMENT
(this "Agreement"),

Purchaser, (the "Purchaser") and Debra Ann Jacques,
(prefix PONDAROZA) the registered
breeder of the subject puppy/dog (the "Breeder").
RIGHT OF FIRST REFUSAL.
In the event the Purchaser for any reason or circumstance whatsoever intends to in any manner rehome
the puppy/dog known as

the Purchaser shall give Pondaroza Kennels the right to purchase the puppy/dog for a mutually
agreed price no higher than the original purchase price paid by the Purchaser, or to rehome the
dog/puppy.
This right shall be extended by Purchaser giving written notice of the intention to rehome said
puppy/dog, requiring Pondaroza Kennels to accept the offer in writing no later than
fourteen (14) days from receipt of said notice.
In the event that Pondaroza Kennels does not purchase the puppy/dog on the terms set forth above,
then the Right of First Refusal granted herein shall lapse.
BREEDING
1. I agree that I will not breed with the abovenamed dog without having first provided
Pondaroza Kennels with a copy of my current prefix and will continually maintain the currency of
said prefix.
2. I agree that I will not breed the puppy under 18 months old if female, and 9 months old if male.
3. I agree that under no circumstances whatsoever will the abovenamed dog be involved in any way in
breeding other than to quality dogs of the same breed duly registered with a relevant canine control
council who’s owner is a current member of the same canine control council and where applicable
holds a current breeders prefix.
4. I agree that all progeny will be registered with the relevant canine control council.
5. I agree that the progeny of any matings involving the abovenamed dog will NOT be sold on Main
Registration at any time without the written approval of Pondaroza Kennels.
6. I agree that in the case of a male puppy or dog being purchased that a service agreement with
identical conditions as Pondaroza Kennel's current service agreement will be required with each
and every outside mating and adhered to.
7. I agree that I will not lease or loan in any way the subject dog to anyone for any purpose
without the express and written approval of Pondaroza Kennels.
8. I agree that I am entitled to main registration ONLY for puppies that are retained by the me,
however should retained puppies be sold at a later date, they are NOT to be sold on main
registration without the written approval of Pondaroza Kennels in regard to both the sale
and main registration.
9. Under NO CIRCUMSTANCES will the puppy/dog be placed in a refuge or rescue
organisation.
If for ANY REASON whatsoever you are not able to
keep the dog/puppy, s/he is to be returned to us at your cost.
10. I agree that failure to adhere to any of the conditions herein will provide Pondaroza
Kennels with the right to reclaim the said puppy/dog. The return of puppy/dog to
Pondaroza Kennels is at the owners' expense.
